<p>One thing to keep in mind is that the people you elect (or maybe I should say the people who find their way to &#8220;public&#8221; office &#8212; since recent history tells us they might not always be elected) don&#8217;t know what&#8217;s on your mind unless you tell them.</p>
<p>Sure they look at polls and surveys and listen to the media &#8212; but pollsters, surveyors, and the media have their own agenda &#8212; and are often funded by big business to make sure their interests are put in the spotlight (favorably).</p>
<p>The best way to let your elected officials know your feelings are to contact them.</p>
<p>When you do contact them; make sure you&#8217;ve written a clear and concise message.  Keep it simple &#8212; you don&#8217;t need to include any extraneous details or information that reasonable people would be aware of.  Tell them who you are if you&#8217;re someone who&#8217;s &#8220;professional&#8221; view on the topic would give it additional credibility.  Make sure any specific details (including enough to identify the legislation or initiative) is included; again if you have information that may not be available provide the facts.  Close your message with the specific action(s) you&#8217;d like to see taken.  If you want a response, include your contact information so that they can reply to you.</p>

			<content:encoded><![CDATA[<p>So Wednesday I read an article that the brigade, battalion, and company commanders in 13 July 2008 attack on Wanat, Afghanistan had been reprimanded following a re-investigation of the matter by Marine Lt Gen Richard Natonski.</p>
<p>Initially the three were not subjected to any disciplinary action; but an independent investigation by Lt Gen Richard Natonski was order after numerous complaints.</p>
<p>After the reprimand for the three officers who were said to have made critical operational mistakes, the soldiers refuted the charges and the US Central Command reversed the decision and cleared the three of any wrong doing.</p>
<p>Seems strange, until you realize that the battalion command, then a lieutenant colonel had been promoted to a full colonel after the incident &#8212; apparently not only did he not do anything wrong, but he must have done something right.</p>
<p>Dr Laurence J Peter and Raymond hull could have used this as a case in point to support <a title="The Peter Principle" href="http://en.wikipedia.org/wiki/Peter_Principle" target="_blank">The Peter Principle</a>.</p>

			<content:encoded><![CDATA[<p>Last Thursday the Supreme Court greatly narrowed the scope of a federal fraud law frequently used to prosecute white-collar criminals.</p>
<p>And guess who might benefit from the decision&#8230;</p>
<p>Enron CEO Jeffrey Skilling among a host of others.</p>
<p>The Supreme Court ruling was the result of an appeal Jeffery Skilling brought before the court.  Skilling actually ask that the &#8220;honest services&#8221; law be struck down as unconstitutional as well as asking for a new trial since he claimed he didn&#8217;t get a fair trial in Houston (I personally don&#8217;t recall him requesting a change of venue &#8212; so apparently he felt he&#8217;d fair better there than most other places people felt he&#8217;d defrauded them out of their life savings).</p>
<p>Justice Ruth Bader Ginsburg&#8217;s written option stated that prosecutors could continue to seek honest services fraud conviction in cases where their is sufficient evidence to show defendants accepted bribes or kickbacks.  Of course Jeffery Skillings isn&#8217;t accused of accepting bribes or kickbacks, just filling his pockets with money at the expense of his investors and customers by knowingly manipulating the energy market.</p>
<p>The court did not specifically throw out any of the nineteen counts against Skilling, nor did they agree to a new trial.</p>
<p>I&#8217;m sure former Illinois Gov. Rod Blagojevich, former Alabama Gov. Don Siegelman, and ex-HealthSouth CEO Richard Scrushy, former newspaper magnate Conrad Black, former Alaska lawmaker Bruce Weyhrauch as well as other will be quick to see what this new ruling might do to help them.</p>
<p>Justices Sonia Sotomayor, Stephen Breyer, and John Paul Stevens were the dissenters; and I once again have to ask what box of cereal Justice Ginsberg clipped her law degree from.</p>
<p>I know, this is America, land of the free; but where the more cash you have, the more &#8220;equitable&#8221; the law.</p>

			<content:encoded><![CDATA[<p>President Barrack Obama toured the <em>Red-Neck Rivera</em> this past Monday&#8230; seeing for himself the damage the Deepwater Horizon drilling platform disaster was wreaking on the Florida, Alabama, Mississippi, and Louisiana coastline.</p>
<p>I appreciate that he used this as a king pin to push (again) for an American commitment to clean and renewable energy&#8230; but maybe for the moment we need to focus more on cleaning this mess up, and preventing future mishaps.</p>
<p>Sure, there&#8217;s plenty of people in Washington to work on all three agendas (though that in itself is part of the problem &#8212; there&#8217;s too many people in Washington &#8212; and no one seems to be responsible for much of anything)&#8230; but let&#8217;s put the best public face on dealing with the crisis du jour &#8212; and not forget de jure or de facto!</p>
<p>Oil and gas companies (like BP) have been making record profits over the past several years.  They&#8217;ve heavily lobbied Congress to get more and more access to public lands for drilling and exploration &#8212; all under the moniker that off shore drilling is perfectly safe, and with that they created a public perception that they had contingency plans to handle everything.</p>
<p>Surprise&#8230;</p>
<p>Not only is off shore drilling not safe; but oil and gas companies haven&#8217;t a clue about how to handle most crisis &#8212; and those record profits they make are at the expense of safely maintaining their equipment and staff.</p>
<p>When you look for where to point a finger &#8212; point it first at the oil and gas companies (BP would be the right place for the Deepwater Horizon disaster)&#8230; then point it at your elected official who accept major campaign contributions from the oil and gas industry &#8212; and they are the ones who control the regulations and the regulators (yeah &#8212; the regulators are to blame as well, but first vote out the idiot who created the system).</p>
<p>Lot of people are saying that very little (or nothing) is really being done to manage this crisis&#8230; but they&#8217;re dead wrong.  That might be their perception &#8212; but lots is being done &#8212; just maybe not the right things, and certainly BP didn&#8217;t do enough in the very early days&#8230; part of that was because they didn&#8217;t have a plan and they didn&#8217;t invest time, energy, and money into planning.</p>
<p>Let&#8217;s be realistic about this &#8212; the oil spill is going to get much worse before it get&#8217;s better.</p>
<p>Oil is still leaking from the Deepwater Horizon.</p>
<p>The spill is now large enough that the currents will almost assuredly take it out of the Gulf of Mexico and into the Atlantic &#8212; where the Gulf Stream will push it North along the Eastern seaboard.</p>
<p>It&#8217;s hurricane season; and it&#8217;s not a matter of if but rather when a storm will enter hurricane alley (remember &#8212; if the oil hits the Gulf Stream almost any storm that comes toward North America will disperse the oil even more).</p>
<p>BP is still clueless as to how to arrest the oil (and still short-sighted I&#8217;m sure).</p>
<p>All we can do is move forward and be prepared&#8230; and hopefully now the mult-member task-force will be able to do a better job managing all the facets of containment and cleanup.</p>

			<content:encoded><![CDATA[<p>Thus far the collapse of the US housing market and [near] failure of Frannie Mae and Freddie Mac have cost US tax payers $145B&#8230; and it&#8217;s far from over.</p>
<p>The New York Stock Exchange have announced that the two companies will be delisted from the exchange next month (the stocks had been trading at the $1 per share mark &#8212; the minimum threshold to remain on the exchange &#8212; for over two years (since before the federal government took control of the companies).</p>
<p>The Federal Housing Finance Agency states that the delisting &#8220;does not constitute any reflection on either [company's] current performance or future direction.&#8221;</p>
<p>Right&#8230;</p>
<p>Fannie and Freddie were created by an act of Congress decades ago&#8230; as private companies.  They buy mortgages from banks, re-sell them to investors, and guarantee to pay off the loans if borrowers default.</p>
<p>And, of course, for the last decade they&#8217;ve been buying junk mortgages that banks irresponsibly made to people who couldn&#8217;t possible afford them on vastly over-valued property.</p>
<p>Of course, the bank&#8217;s weren&#8217;t the losers; the shareholders of Fannie Mae and Freddie Mac largely lost their proverbial shirts &#8212; but the tax payers bailed out the banks (and continue to fund Fannie and Freddie &#8212; and they continue to lose money).</p>
<p>Congress will have to decide how to handle this mess.  A GAO report last fall included these points.</p>
<ol>
<li>Create a government agency to buy mortgages and re-sell them to investors. This would eliminate the profit motive that, some critics say, drove Fannie and Freddie to take the risks that led to their demise. It would also continue to subsidize the mortgage market, making it easier for Americans to buy homes. On the other hand, the government would still be putting lots of taxpayer money at risk to subsidize the housing market.</li>
<li>Reconstitute Fannie and Freddie as government-sponsored enterprises, similar to the way they were before. This might be accompanied by new rules limiting the risks the companies can take. Still, this would bring back the problematic ambiguities of having private, government-sponsored companies.</li>
<li>Dramatically reduce the government&#8217;s role in the mortgage business. In this model, there would essentially be no replacement for Fannie and Freddie. But the government might still take some role, such as selling insurance to cover mortgage default. This would reduce (but not eliminate) the risk to taxpayers, but it might also make it more difficult for people to get mortgages.</li>

			<content:encoded><![CDATA[<p>Right away after the explosion of the Deepwater Horizon Swiss company Transocean Ltd moved to have their liability for damages limited to the cost of the &#8220;sunken ship&#8221; ($27 million) citing an 1851 law that says the owner of a sunken vessel is liable only for its value after the accident.</p>
<p>Transocean expects to receive $560 million in insurance, so subtracting what they consider their maximum liability they&#8217;d just about meet their three year revenue projection under the BP contract.</p>
<p>Hmm&#8230;</p>
<p>Many of the judges are recusing themselves from hearing cases involving the oil spill; but I&#8217;d say if a federal judge in Houston makes a ruling we&#8217;ve certainly found a judge that can no longer recuse himeself (though he might be a candidate for impeachment)&#8230; my guess is Transocean will not get their ruling quickly, and likely will not get a ruling they like ever.</p>
<p>Transocean CEO Steven Newman told investors in addition that its contract with BP holds BP entirely responsible for all damages and liability from the spill.</p>
<p>I guess Newman isn&#8217;t totally confident of the petition filed in federal court, or his contractual liability limits so he&#8217;s working both ends&#8230; and is probably worried that a review will show negligence on his company&#8217;s part &#8212; which could cause a judge to throw out any and all liability limits.</p>
<p>BP, Halliburton, and Transocean are each responsible, and each of them should (and hopefully will) be held accountable for this mess &#8212; and their massive profits will be used to undo the damage their greed has caused.</p>
<p>As I&#8217;ve said before &#8212; make the problem expensive enough for them to allow to continue; and any future problem much more expensive for them to clean up &#8212; and we won&#8217;t have to worry much about the spill continuing&#8230; or ever happening again (just take highest quarter&#8217;s profits from the last year, divide by 90 &#8212; and that&#8217;s the daily fine).</p>

			<content:encoded><![CDATA[<p>I&#8217;ve often said that the one fundamental human trait that Karl Marx always failed to consider when he talked about socialism was the intense greed that drive most humans.</p>
<p>Greed, the failing of socialism, is largely the driving force that makes capitalism work.</p>
<p>The United States doesn&#8217;t have a totally free market economy; the government regulates many aspects of businesses &#8212; perhaps it shouldn&#8217;t or perhaps it should regulate more &#8212; there&#8217;s always a good argument on both sides.</p>
<p>Maybe it&#8217;s time that the United States government regulated businesses by exactly the same set of laws that it regulates individuals by.</p>
<p>Giving corporations the exact same rights and privileges, and subjecting them to the exact same legal and tax structure.</p>
<p>Powerful corporations have too long tried to manipulate society and government to satisfy their greed, and such manipulation in the long run puts an undo burden on society.</p>
<p>I see few alternatives for our society to grow and flourish.</p>
<p>Since humans will likely never be able to build a Utopian society, socialism (or any system like it) is not an option&#8230; since the powerful (and rich) will it seems always try and manipulate society to satisfy their own selfish greed we cannot depend on them &#8220;to do what&#8217;s right&#8221;.</p>
<p>How then do we build a society that will last and continue to grow?</p>
<p>Level the playing field &#8212; through insuring that one tenant of socialism lives on: from each according to their ability (where in this case, ability is wealth).</p>
<p>Long ago when I was much more idealistic I felt that the progressive tax system the United States uses was wrong&#8230;</p>
<p>Now I believe that a progressive tax system, with no deductions, treating all individuals and all corporations equally might be the absolute best solution.</p>
<p>Corporations will scream that their profits will suffer &#8212; but in the end greedy corporations will pass along those costs to individuals&#8230; the ones what will suffer will be the very rich&#8230; they will start paying their fair share (those who profit from society should bear a much larger portion of the costs of propagating it).</p>
<p>I&#8217;d prefer a better solution, but until humankind changes, we have to deal with realistic solutions to real problems.</p>

			<content:encoded><![CDATA[<p>Yesterday CNN provided details from five survivors of the explosion on 20 April 2010 causing the destruction of the Deepwater Horizon drilling platform and the subsequent devastation caused by the oil leak.</p>
<p>The survivors&#8217; account indicates that BP&#8217;s greed driven short cuts to dealing with critical problems aboard the Deepwater Horizon for over nine months; including forcing the rig&#8217;s chief mechanic to use a cost/time saving procedure he was uncomfortable with on the day of the explosion.</p>
<p>Read it (and watch it) yourself; draw your own conclusions&#8230; but remember, CNN is not a liberal news source &#8212; and if they&#8217;re pointing fingers at big business it&#8217;s either because big business is undeniably at fault, or that&#8217;s where the ratings are (don&#8217;t underestimate the greed at CNN).</p>

			<content:encoded><![CDATA[<p>For years the oil and gas companies have been telling us (the American public) how safe off shore drilling is, and they&#8217;ve been trying to convince us that they have contingencies for anything that might happen, and that there&#8217;s no substantial risk to our environment.</p>
<p>Well, take a look at the Deepwater Horizon oil platform in the relatively tame Gulf of Mexico and the inability of the world&#8217;s largest oil company to stop (or even really slow) a huge oil leak and consider who ill prepared the oil companies would be to handle a spill anything like this is the Gulf of Alaska (or any place near the Artic) in the middle of the Winter &#8212; or what could happen in the Gulf of Mexico or Atlantic seaboard during hurricane season.</p>
<p>Yes, I think it&#8217;s a travesty that the Federal Government didn&#8217;t have any contingency plans for oil spills of this magnitude &#8212; but don&#8217;t point a finger at the current administration; you&#8217;ll find that&#8217;s been years and years in the making (and least you forget, we just had an &#8220;oil and gas man&#8221; in the Whitehouse for eight years), but in the end, it is the industry itself that is ultimately responsible for the impact of their decisions to use such a small amount of their profits to insure the safety of their endeavors &#8212; and it is the companies that should be made to pay for the damages they&#8217;ve caused.</p>
<p>Damages to the coastal ecosystem of Louisiana, Mississippi, Alabama, and Florida are increasing hourly as BP does little to stem the disaster &#8212; except possibly try and contain the public relations damage.  While BP stock is down 40%, first quarter 2010 saw record profits &#8212; and in the end, I suspect BP will find a way to pass all the costs and loses onto consumers and reward their investors.  BP CEO Tony Hayward has already assured investors that the company has &#8220;considerable firepower&#8221; to cope wit the severe costs&#8230; but missing are statements to the world that they&#8217;ll commit the &#8220;firepower&#8221; it&#8217;ll take resolve this disaster.</p>
<p>Bottom line, perhaps rather than increasing the leases for off-shore drilling it&#8217;s time to pull back all the currently unused leases and start heavily fining the oil and gas industry for any and all violations.</p>
